A Limuru court yesterday ruled that Neno Evangelism Pastor James Ng’ang’a will not be subjected to a DNA test in relation to a case on a fatal accident he allegedly caused.
Limuru senior resident magistrate Timothy ole Tanchu said the DNA test should have been conducted before Ng’ang’a was charged.
Last week, prosecutors Alloys Kemo and Catherine Mwaniki urged the court to allow investigators to conduct a DNA test on Ng’ang’a, saying the charges against him are serious.
Mwaniki yesterda said they will appeal the ruling at the High Court.
Ng’ng’a has been charged with causing death by dangerous driving, failing to report an accident, giving false information to police and conspiracy to defeat justice.
He is charged alongside Simon Kuria and two police officers, Christopher Nzilu and Patrick Baya.
Ng’ang’a allegedly caused the death of Mercy Njeri in an accident on July 26 at Manguo in Kiambu county.
Meanwhile, lawyer Cliff Ombeta, who was representing Ng’ang’a, withdrew from the case, citing insecurity.
Ombeta said his car and that of his client were pelted with stones by residents who were standing outside the court’s gate.
Another defence lawyer, Assa Nyakundi, said he was forced to use a different car and route yesterday, as his usual car is known to the public who insulted him.
