Student caught with bhang in her underpants sues state seeking Sh7m compensation


A form four student caught with bhang in her underpants has sued the state, seeking Sh7 million for violating her privacy.

The 18-year-old is among 37 students profiled by police for being intoxicated and having sex in a bus at Sagana.

She had been charged with being in possession of bhang, an offence she pleaded guilty to.

Through Kioko, Ngugi and Company advocates, the student says in an attempt to obtain evidence, officers lifted her skirt and removed her blouse.

They took photographs of her in the nude in the presence of male persons.



“I am suffering from shame, pain and sorrow as a result of grossly invasive misconduct on the part of officers of the IG at Sagana police base,” she says.

The IG and the DPP have secured a conviction and sentence of the 18-year-old based on what she terms as unlawfully obtained facts.

She says the sentence stands as double jeopardy and unless orders are granted she will endure inflated shame, misery and low self-esteem that cannot be compensated in monetary terms.

The 18-year-old seeks to have the court set aside her conviction and an order to the DPP to institute criminal proceedings against the officers for the unlawful action.
